Hearing on new death warrant today in Nirbhaya case

New Delhi: Every day, in the case of Nirbhaya, who has been moving continuously for the last 8 years, we get to see some new stop. At the same time, the mercy petition of Pawan Kumar Gupta, one of the poor of Nirbhaya, has been rejected by President Ram Nath Kovind on Wednesday, March 4, 2020. An official of the Ministry of Home Affairs gave this information. With this, all the options of the four poor men Pawan Gupta, Akshay Thakur, Vinay Sharma, and Mukesh Singh are over. Due to the pending mercy petition of Pawan, the hanging of the poor people on March 3 has been postponed. At the same time, with the dismissal of Pawan's application, the Tihar Jail administration applied for a new date of hanging in the Patiala House Court. This will be heard today.

In the meantime, advocate Seema Kushwaha, on behalf of the family of Nirbhaya, told that she is going to give an appeal for the new date of the hanging of the four convicts. Whereupon he said, all the culprits have used all their legal rights. Now the date will be fixed, it will be the last date. However, Akshay has also sent a new mercy petition to the President, which has been argued that there were not enough facts in the first mercy petition. The corrective petition has already been rejected by the Supreme Court on Monday in the case of Pawan. After this, Pawan had only the option of mercy petition. According to the rules, even after the mercy petition is rejected, the convict gets 14 days before hanging him. Earlier, the hanging of the culprits has been postponed thrice on January 22, February 1 and March 3.

The Delhi government moved the Tis Hazari Court on Wednesday. The Delhi government told Judge Dharmendra Rana's court that after Pawan's mercy petition was rejected by the President, all the options of the culprits were over. On this, Judge Rana has issued a notice to the convicts to give their reply on Thursday i.e. today, 5 March 2020. Judge Rana said the principle of natural justice is under Article 21 (Right to Life and Personal Freedom) of the Constitution. In such a situation, the other side cannot be ignored.
